1. Acceptance of Terms
By accessing or using 10XStrategy.Digital (the “Site”) and our services (the “Services”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Site or Services.
2. Our Services
We provide consulting, setup, and management of marketing automation, including GoHighLevel (“GHL”) implementations, communication workflows, and related advisory. Specific deliverables are defined in your order form, proposal, or statement of work.
3. Eligibility & Accounts
● You must be at least 18 years old and have authority to bind your organization.
● You are responsible for safeguarding access credentials and for all activity under your account.
● Provide accurate information; notify us of changes promptly.
4. Fees, Payments & Refunds
● Fees are as listed at checkout or in a written agreement. Taxes may apply.
● Recurring subscriptions renew automatically unless canceled per the stated notice period.
● Due to the nature of strategy and setup work, fees are generally non‐refundable once work has begun. Any exceptions will be stated in your agreement.
● Late or failed payments may suspend or terminate access to Services.
5. User Content & Licenses
You retain ownership of content you provide. You grant us a non‐exclusive license to use such content solely to deliver the Services. You represent that you have rights to all content you supply.
6. Acceptable Use
● No unlawful, harmful, deceptive, or infringing activity.
● No abuse of communications tools (spam, unsolicited messaging, or violations of carrier/A2P rules).
● Comply with applicable laws (including TCPA/CTIA for SMS, CAN‐SPAM, privacy and data rules).
7. Communications (SMS/Email)
By providing your contact details, you agree that we may send you transactional communications related to your account or Services. With your consent, we may also send marketing communications. Message frequency may vary. Message & data rates may apply. You can reply STOP to opt out of SMS marketing or HELP for assistance. Opting out of marketing messages will not affect transactional messages essential to your Services. See our Privacy Policy for details.
8. Appointments & Calendars
Booking a time on our calendar constitutes a request for a consultation. We may reschedule for cause. You are responsible for providing accurate information and attending at the selected time.
9. Intellectual Property
The Site, designs, templates, and proprietary materials are owned by us or our licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, or distribute Site materials.
10. Third‐Party Services
Our Services may integrate with third‐party platforms (e.g., GHL, email/SMS providers, analytics). Your use of third‐party services is subject to their terms and policies. We are not responsible for third‐party actions, outages, or data handling.
11. Disclaimers
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‐INFRINGEMENT. RESULTS VARY BASED ON MANY FACTORS OUTSIDE OUR CONTROL.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR AFFILIATES WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to defend, indemnify, and hold harmless 10XStrategy.Digital and its affiliates from claims arising out of your use of the Services, your content, or your violation of these Terms or applicable law.
14. Termination
We may suspend or terminate access to the Site or Services for any violation of these Terms, non‐payment, or as otherwise permitted by agreement or law. Upon termination, provisions intended to survive (including ownership, payment obligations, and limits of liability) shall remain in effect.
15. Governing Law & Disputes
These Terms are governed by the laws of [Your State/Country], without regard to conflict‐of‐law principles. Disputes will be resolved in the state or federal courts located in [Your Venue], unless otherwise required by law. You consent to personal jurisdiction in those courts.
16. Changes to Terms
